Terms & Conditions

1.1 Acceptance. Use of the Platform in any form constitutes acceptance of this Agreement. Where a User accepts on behalf of an organisation (such as a club or sponsor), the individual accepting warrants that they have authority to bind that organisation.

1.2 Eligibility. Accounts may be created only by individuals aged 16 or over. Users under the age of 18 must obtain verifiable consent from a parent or legal guardian, and may not enter into paid tournaments, hardware purchases, or marketplace transactions without that consent.

1.3 Sanctions and Restrictions. The Platform is not available to Users located in, or ordinarily resident in, any jurisdiction subject to comprehensive sanctions by the United Kingdom, the European Union, or the United Nations Security Council.

1.4 One Account Rule. Each natural person is entitled to one personal account. Duplicate accounts created to circumvent suspensions or bans constitute fraud and are subject to the sanctions in Section 9.

2.1 Permanent Hierarchical ID Systems. Every registered Loft receives an unalterable, lifecycle-persistent IHFP Loft ID. Every entered bird receives an immutable IHFP Pigeon ID linked permanently to its baseline biometrics (eye colour, profile photograph, ring index, and lineage data). Ownership transfers, gifting, and inherited loft estates must be processed exclusively through the Platform's internal instruments to preserve historical score metrics. Off-Platform transfers are not recognised.

2.2 Multi-Loft Management. A single designated master account may construct, maintain, and administer multiple physical or geographical competition lofts. Each operational loft maintains independent statistical records, regional placement rankings, and distinct referee check-in points. Financial liabilities remain consolidated under the primary billing profile.

2.3 Ustad–Shaagird Registry. The sacred lineage of the Ustad–Shaagird framework is formally digitised. The creation or structural modification of these affiliations requires mutual cryptographically backed dual-factor confirmation from both verified accounts. Once authenticated, a permanent, unalterable lineage tree is published on the Platform's searchable registry.

2.4 Account Security. Users must protect their credentials, enable multi-factor authentication where offered, and notify the Company within 24 hours of any suspected unauthorised access. The User remains liable for all activity on their account until the Company confirms suspension.

2.5 Verified Status. The Company may grant verified status to public Ustads, professional lofts, sponsors, and clubs. Verified status carries enhanced visibility but also enhanced compliance obligations under Sections 6, 9 and Part III.

3.1 Pricing and Currency. Prices are displayed in the User's local currency where supported, otherwise in GBP, USD, AED, or PKR as indicated at checkout. The currency shown at checkout is binding for that transaction. All prices are inclusive of applicable VAT or sales tax unless stated otherwise.

3.2 Entry Fee Escrow. Tournament entrance fees are collected electronically and held in a secure, automated ledger until the relevant race sequence or tournament completes and the verified landing results are audited and locked by administrative staff. The Company is not a bank and the funds held in escrow do not constitute deposits.

3.3 Automated Prize Pool Splitting. The prize matrix, comprising cumulative entry fees and tiered corporate brand sponsorships, is computed dynamically and displayed on the event interface before registration opens. Upon final confirmation of results, prize distributions are programmatically dispatched to the winning profiles, subject to any deductions for sanctions, fines, or tax withholding required by applicable law.

3.4 Hardware Purchase and Recurring Data Subscriptions. The IHFP Loft Guard camera module is sold under a blended commercial model: an initial hardware purchase fee, followed by monthly recurring SaaS data subscriptions. Subscriptions cover persistent cloud storage archives, continuous 4G data routing, and real-time motion detection push alerts. Failure to maintain an active subscription tier will result in instant device deactivation and the unit becoming ineligible as an official race timestamp mechanism.

3.5 Marketplace Commissions. Transactions involving avian nutritional items, veterinary equipment, and peer-to-peer pigeon trading attract an automated marketplace commission, retained by the Company. The current commission rate is published on the marketplace help page and may be changed on 30 days' notice. Every peer-to-peer bird transaction must update the IHFP Pigeon ID ledger.

3.6 Failed Payments. Where a recurring payment fails, the Company will retry the charge up to three times over seven days. If unresolved, the associated subscription will be downgraded or suspended.

3.7 Refund Policy. Hardware refunds are governed by the consumer law of the User's jurisdiction. Standard hardware returns are accepted within 14 days of delivery if unused and in original packaging. Tournament entry fees are non-refundable once the tournament window has opened, except where the event is cancelled by the Company. Subscription fees are refundable on a pro-rata basis only where required by applicable consumer law.

3.8 Chargebacks. A User who initiates a chargeback without first attempting to resolve the dispute through the Platform's appeals procedure may have their account suspended pending resolution and may be liable for the Company's reasonable administrative costs.

4.1 Title and Risk. Title to Loft Guard hardware passes to the User upon receipt of full payment in cleared funds. Risk of loss or damage passes to the User upon delivery.

4.2 Limited Warranty. The Company warrants the Loft Guard hardware against defects in materials and workmanship for a period of 24 months from the date of delivery. Warranty service, at the Company's option, consists of repair, replacement, or refund of the original purchase price.

4.3 Warranty Exclusions. The warranty does not cover damage caused by: (a) misuse, neglect, or unauthorised modification; (b) exposure to conditions outside the published environmental specifications; (c) damage by pests, birds of prey, or other animals; (d) acts of God; or (e) any tampering intended to alter timestamps or telemetry.

4.4 Firmware Updates. The Loft Guard may receive over-the-air firmware updates that are necessary for security, accuracy, or regulatory compliance. The User consents to such updates being applied automatically.

4.5 Right to Disable for Tamper. Where the Platform detects credible evidence of physical or signal tampering with a Loft Guard, the Company may immediately disable that unit and quarantine the associated race data pending investigation.

5.1 Role of the Company. The Company operates the marketplace as a facilitator. It is not a party to peer-to-peer sales and does not warrant the quality, fitness, or biometric authenticity of listed birds or third-party products.

5.2 Listing Obligations. Sellers must disclose all known defects, must hold the necessary licences for international shipment of livestock where applicable, and must use only IHFP Pigeon IDs that match the bird actually offered.

5.3 Prohibited Listings. Listings of birds that bear any disqualified traits identified in Part III, Section 2 are prohibited. Listings of veterinary medicines requiring prescription are prohibited unless the seller is a licensed veterinary supplier.

5.4 Buyer Protection. Where a buyer receives a bird whose biometrics materially diverge from the listed IHFP Pigeon ID record, the Company will hold the purchase funds in escrow until the dispute is resolved under Section 13.

Users must not, and must not permit any third party to:

• Upload, transmit, or publish any content that is unlawful, defamatory, obscene, or that infringes the rights of others;
• Harass, threaten, or abuse another User, a Judge, an Ustad, a Shaagird, or any employee or contractor of the Company;
• Use the Platform for any commercial purpose not expressly permitted by these terms;
• Reverse engineer, decompile, or attempt to derive the source code of the mobile application, web dashboard, or Loft Guard firmware;
• Probe, scan, or test the vulnerability of the Platform's network or systems;
• Submit knowingly false, misleading, or manipulated biometric, video, or telemetry data;
• Engage in coordinated behaviour intended to manipulate leaderboards, rankings, or prize allocations.

7.1 Company IP. All rights, title, and interest in and to the Platform, including the IHFP brand, logos, the IHFP Loft ID and IHFP Pigeon ID schema, the leaderboard architecture, the Loft Guard firmware, and all associated documentation, are and remain the exclusive property of the Company.

7.2 Limited Licence to Users. The Company grants each User a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal participation in the sport.

7.3 User Content Licence. By uploading photographs, video, lineage records, written commentary, or any other material, the User grants the Company a worldwide, royalty-free, sub-licensable licence to host, store, reproduce, display, adapt for format, and publicly broadcast that material.

7.4 Trademark Use. Users may not use the IHFP marks in any manner that suggests endorsement, sponsorship, or affiliation without prior written authorisation.

8.1 Responsibility. Users are solely responsible for the content they upload to the Platform.

8.2 Community Standards. Discussion forums, comments under leaderboards, club pages, and live event chats are governed by the IHFP Community Guidelines.

9.1 Critical Sanction Clause. Any User found using software manipulation, deep-fake validation videos, physical biometric masking, signal jamming against IoT devices, or colluding with an opposing Judge to register fraudulent flight durations will face an immediate, absolute three-year global ban from all IHFP systems, marketplace interfaces, and tournaments.

9.2 False Accusations. False accusations of fraud made without clear evidence will trigger an identical three-year structural ban and a financial fine.

9.3 Abusive Conduct. Any use of explicit, abusive, or threatening remarks directed toward a stationed Referee or an executive administrator will prompt immediate platform access cancellation.

10.1 Termination by User. Users may close their account at any time through the in-app settings menu.

10.2 Termination by the Company. The Company may suspend or terminate access for material breach of this Agreement, for fraud, for non-payment, or where required by law.
